These General Terms and Conditions apply to all treatment agreements, whether entered into verbally or in writing, between Limen PsyAssist B.V. and the client. By engaging our services, you agree to these terms.

1. About Limen PsyAssist

Limen PsyAssist B.V. is a private psychology practice based in Leiden, the Netherlands. We provide psychological assessment and treatment within the Specialised Mental Health Care (Specialistische GGZ) framework. Our practice operates under the following details:

Our team includes psychologists with a range of qualifications: master's-level psychologists (including NIP-registered en SKJ basispsychologen), GZ-psychologists, and clinical psychologists. All psychologists work within the scope of their individual registration and competence, in accordance with the professional code of conduct of the Netherlands Institute of Psychologists (NIP) and/or the Dutch Association of Pedagogical Scientists and Educational Experts (NVO).

2. The Treatment Agreement

2.1 The treatment relationship between Limen PsyAssist and the client is governed by a treatment agreement (behandelovereenkomst) as defined in the Dutch Medical Treatment Contracts Act (WGBO, Boek 7, Titel 7, Afdeling 5 BW).

2.2 The treatment agreement is established at the moment the client accepts the intake appointment. No treatment will commence without the client's explicit informed consent.

2.3 The client has the right to refuse or withdraw consent for any part of the proposed treatment at any time, without this affecting the rest of the care relationship, except where continuation of treatment would no longer be clinically responsible.

2.4 Limen PsyAssist reserves the right to decline a referral or discontinue treatment if the requested care falls outside the scope of our practice's competence or services.

3. Referral and Eligibility

3.1 Limen PsyAssist is currently in the process of obtaining the required WTZA registration for insured mental health care. Until this registration is complete, all treatment is offered on a self-pay basis. Clients will be informed as soon as insured care becomes available. We are happy to provide a detailed invoice that clients may submit to their own health insurer for potential reimbursement, depending on their individual policy and coverage.

3.2 Limen PsyAssist will assess at intake whether the client's care needs fall within the scope of our practice and whether we are able to provide the appropriate care. If this is not the case, we will communicate this clearly and, where possible, assist the client in finding an alternative provider.

4. Fees, Insurance, and Payment

4.1 Current payment model: Limen PsyAssist currently operates on a self-pay basis. Fees for treatment will be agreed upon in writing before the start of treatment. An overview of current rates is available on our website and upon request. As noted in Article 3, clients are welcome to submit our invoices to their health insurer for potential reimbursement under their supplementary insurance policy.

4.2 Future insured care: Once our WTZA registration is complete, we intend to offer treatment within the insured care framework (Zorgverzekeringswet, Zvw). At that point, these Terms and Conditions will be updated accordingly, and clients will be informed in advance.

4.3 Client's responsibility: It is the client's own responsibility to verify their insurance coverage and reimbursement conditions with their health insurer. Limen PsyAssist cannot be held liable for costs arising from incomplete or incorrect insurance coverage.

4.4 Invoices are sent digitally and are payable within 30 days of the invoice date. In case of late payment, Limen PsyAssist reserves the right to charge statutory interest and to suspend treatment until the outstanding balance has been settled.

4.5 In case of persistent non-payment, the outstanding amount may be transferred to a debt collection agency. Any associated collection costs will be charged to the client.

5. Cancellation and No-Show Policy

5.1 Appointments must be cancelled or rescheduled at least 24 hours in advance. Cancellations within 24 hours of the scheduled appointment, or failure to attend without prior notice (no-show), will be charged at the full session rate. Reserved time that goes unused at short notice represents a direct cost to the practice that cannot be recovered.

5.2 Cancellations must be made by telephone or email to info@limenpsy.nl. A cancellation is only valid once confirmed by our practice.

5.3 In exceptional circumstances (e.g. acute illness or emergency), the practice may waive the cancellation fee at its own discretion. This will always be assessed on a case-by-case basis.

5.4 Repeated cancellations or no-shows may affect the continuation of the treatment relationship. The treating psychologist will discuss this with the client if it becomes a recurring pattern.

6. Privacy and Data Protection

6.1 Limen PsyAssist processes personal data — including special category data (health data) — in accordance with the General Data Protection Regulation (GDPR/AVG) and the Dutch Implementation Act (UAVG).

6.2 Your data is used exclusively for the purposes of treatment, administration, and legally required reporting. We do not share your personal information with third parties without your explicit consent, except where legally required (e.g. mandatory reporting obligations).

6.3 Routine Outcome Monitoring (ROM): Clients may be asked to complete questionnaires to monitor symptoms, treatment progress and outcomes (Routine Outcome Monitoring, ROM). The results form part of the treatment record and are used to support and evaluate treatment.

6.4 Medical records: Your treatment file (dossier) is retained for a minimum of 20 years after the end of treatment, in accordance with the WGBO (as amended in 2020). You have the right to access, correct, and — under certain conditions — request the deletion of your records.

6.5 Communication with your GP: Where treatment is initiated on referral from a GP, we will routinely share a treatment plan and a closing report with the referring GP, unless you explicitly object. You may also request copies of any correspondence sent on your behalf.

7. Professional Standards and Quality

7.1 Our team includes psychologists at different levels of qualification and registration — from master's-level (NIP-registered) psychologists to GZ-psychologists and a clinical psychologist. All psychologists work strictly within the scope of their own competence and registration, in accordance with the NIP and/or NVO professional code of conduct, the Quality, Complaints and Disputes in Healthcare Act (Wkkgz), and the applicable clinical guidelines and care standards.

7.2 Treatment at Limen PsyAssist is always provided under the final clinical responsibility of a designated BIG-registered supervising clinician (regiebehandelaar) — either a GZ-psychologist or clinical psychologist. This structure ensures that all care trajectories are appropriately overseen, regardless of which psychologist you work with directly. Your regiebehandelaar will be introduced to you at the start of your treatment.

7.3 We are committed to continuous professional development and quality improvement. Our practice participates in ROM, peer consultation, and supervision as part of ongoing quality assurance.

8. Confidentiality

8.1 All psychologists at Limen PsyAssist are bound by professional confidentiality (beroepsgeheim). Information about you will not be shared with others without your explicit consent, subject to the exceptions described in Article 6 and any applicable legal obligations.

8.2 Within the practice, information may be shared on a need-to-know basis among treating professionals directly involved in your care, in accordance with the principle of functional necessity.

9. Crisis and Out-of-Hours Care

9.1 Limen PsyAssist is not a crisis service and does not provide out-of-hours emergency care.

9.2 In the event of a psychiatric crisis during office hours, clients are asked to contact their treating psychologist or our general number directly.

9.3 Outside office hours, in the event of a crisis or acute psychiatric emergency, clients should contact:

  • Their GP or GP emergency service (huisartsenpost)
  • The GGZ crisis line in their region
  • Emergency services (112) in life-threatening situations

10. Complaints

10.1 Limen PsyAssist takes complaints seriously and handles them carefully and promptly. If you have a complaint about your treatment or the conduct of a staff member, we encourage you to raise it directly with your treating psychologist or with the practice management.

10.2 If your complaint cannot be resolved internally, you may submit it to an independent complaints officer (klachtenfunctionaris) via our complaints procedure, which is available on our website.

10.3 If the complaint remains unresolved after mediation, you may submit a formal complaint to the Disputes Committee (Geschillencommissie Zorg), to which Limen PsyAssist is affiliated.

10.4 In cases involving alleged professional misconduct, you also have the right to file a complaint with the BIG disciplinary tribunal (tuchtcollege).

11. Liability

11.1 Limen PsyAssist provides its services with the care that may reasonably be expected of a competent healthcare provider. We cannot guarantee specific treatment outcomes, as the effectiveness of psychological treatment depends on many factors, including the client's own engagement and personal circumstances.

11.2 Limen PsyAssist's liability for any damage arising from the provision of services is limited to the amount covered by our professional indemnity insurance (beroepsaansprakelijkheidsverzekering).

11.3 Limen PsyAssist is not liable for indirect or consequential damages.

12. Amendments

12.1 Limen PsyAssist reserves the right to amend these General Terms and Conditions at any time. Amendments will be communicated to existing clients at least one month before they take effect, via our website and/or by email.

12.2 The most recent version of these Terms and Conditions is always available on our website at www.limenpsy.nl.

13. Applicable Law and Jurisdiction

13.1 These Terms and Conditions are governed by Dutch law.

13.2 Any disputes arising from these Terms and Conditions or the treatment agreement will, where not resolved through the complaints procedure described in Article 10, be submitted to the competent court in the district of Den Haag, the Netherlands.
